Harvey Moeis Sentenced to 20 years in Prison

SEAToday.com, Jakarta - The Jakarta High Court (PT DKI Jakarta) increases the sentence of defendant Harvey Moeis to 20 years in prison and a fine of IDR 1 billion with a subsidiary of 8 months in prison.
The appeal ruling was read by the Presiding Judge, Teguh Harianto, at the Jakarta High Court, Cempaka Putih, Central Jakarta, on Thursday (13/2).
Presiding Judge Teguh Harianto explained that the sentence was increased following the acceptance of an appeal from the Public Prosecutor (JPU) of the Attorney General's Office (Kejagung) and Harvey's legal counsel.
The Jakarta High Court also increased the additional penalty of restitution for Harvey to IDR420 billion, with a subsidiary of 10 years in prison.
In deciding the appeal, the Panel of Judges considered several aggravating factors, including that Harvey's actions did not support the government's program to combat corruption.
"The defendant's actions also greatly hurt the public, as during a time of economic hardship, the defendant committed a corruption crime," the Presiding Judge added as quoted on Antara.
Previously, the Corruption Court at the Central Jakarta District Court sentenced Harvey to 6 years and 6 months in prison, a fine of IDR 1 billion with a subsidiary 6-month prison sentence, and restitution of IDR 210 billion with a subsidiary 2 years in prison for committing corruption tin commodity trade in the Mining Business License (IUP) area at PT Timah Tbk from 2015 to 2022, resulting in state losses of IDR300 trillion.
The losses included IDR2.28 trillion from the lease of processing equipment with a private smelter, IDR 26.65 trillion from payments for tin ore to PT Timah's mining partners, and IDR 271.07 trillion in environmental damage.Harvey was also proven to have received IDR 420 billion alongside Manager Helena Lim of PT Quantum Skyline Exchange (QSE) and engaged in money laundering with the money received.
As such, Harvey was found to have violated Article 2 paragraph (1) in conjunction with Article 18 of Law No. 31/1999 on Corruption Eradication, as amended by Law No. 20/2001, and Article 3 of Law No. 8/2010 on the Prevention and Eradication of Money Laundering in conjunction with Article 55 paragraph (1) of the Penal Code of Indonesia.
