Harvey Moeis Dituntut 12 Tahun Penjara dan Denda 1 Miliar di Kasus Korupsi Timah

SEAToday.com, Jakarta - Harvey Moeis dituntut pidana penjara selama 12 tahun dan denda Rp1 miliar terkait kasus dugaan korupsi pengelolaan tata niaga komoditas timah di wilayah izin usaha pertambangan (IUP) PT Timah pada tahun 2015–2022.
"Kami menuntut agar majelis hakim menyatakan terdakwa Harvey Moeis terbukti secara sah dan meyakinkan melakukan tindak pidana korupsi dan tindak pidana pencucian uang," ujar Jaksa Penuntut Umum (JPU) Kejaksaan Agung Ardito Muwardi dalam sidang pembacaan tuntutan di Pengadilan Tipikor Jakarta, Senin (9/12/2024).
Harvey juga dituntut pidana denda sejumlah Rp1 miliar dengan ketentuan apabila denda tersebut tidak dibayar, maka diganti dengan pidana kurungan selama satu tahun.
JPU juga menuntut majelis hakim agar menjatuhkan pidana tambahan kepada Harvey berupa pembayaran uang pengganti sebesar Rp210 miliar subsider pidana penjara selama enam tahun.
Harvey pun dituntut telah melanggar Pasal 2 Ayat (1) juncto Pasal 18 Undang-Undang (UU) Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan UU Nomor 20 Tahun 2001 jo. Pasal 55 ayat (1) ke-1 KUHP dan Pasal 3 UU Nomor 8 Tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Korupsi jo. Pasal 55 ke-1 KUHP, sebagaimana dalam dakwaan kesatu primer.
JPU mempertimbangkan beberapa hal yang memberatkan dalam melayangkan tuntutan kepada Harvey, yakni perbuatan Harvey tidak mendukung program pemerintah dalam rangka penyelenggaraan negara yang bersih dan bebas dari korupsi, kolusi, dan nepotisme.
Selanjutnya, atas perbuatannya tersebut telah menyebabkan kerugian negara yang sangat besar yaitu Rp300 triliun, telah menguntungkan diri Harvey sebesar Rp210 miliar, dan Harvey berbelit-belit dalam memberikan keterangan di persidangan.
Akan tetapi, Harvey yang belum pernah dihukum sebelumnya menjadi hal meringankan yang dipertimbangkan oleh JPU.
