Jokowi Teken PP Kesehatan Baru, Izinkan Aborsi Bersyarat

SEAToday.com, Jakarta - Pemerintah mengizinkan praktik aborsi bersyarat yang tertuang dalam Peraturan Pemerintah (PP) RI Nomor 28 Tahun 2024 tentang Peraturan Pelaksanaan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. PP ini telah diteken oleh Presiden Joko Widodo (Jokowi).
"Setiap Orang dilarang melakukan aborsi, kecuali atas indikasi kedaruratan medis atau terhadap korban tindak pidana perkosaan atau tindak pidana kekerasan seksual lain yang menyebabkan kehamilan sesuai dengan ketentuan dalam kitab undang-undang hukum pidana," demikian bunyi Pasal 116 PP 28/2024 itu.
Indikasi kedaruratan medis meliputi:
- kehamilan yang mengancam nyawa dan Kesehatan ibu; dan/atau
- kondisi Kesehatan janin dengan cacat bawaan yang tidak dapat diperbaiki sehingga tidak memungkinkan hidup di luar kandungan.
Pasal 118 PP28/2024 berbunyi, "Kehamilan akibat tindak pidana perkosaan atau tindak pidana kekerasan seksual lain yang menyebabkan kehamilan sebagaimana dimaksud dalam Pasal 116 dibuktikan dengan:
a. surat keterangan dokter atas usia kehamilan sesuai dengan kejadian tindak pidana perkosaan atau tindak pidana kekerasan seksual lain yang menyebabkan kehamilan; dan
b. keterangan penyidik mengenai adanya dugaan perkosaan dan/atau kekerasan seksual lain yang menyebabkan kehamilan."
Sementara, berikut bunyi Pasal 122 PP28/2024:
- Pelayanan aborsi hanya dapat dilakukan atas persetujuan perempuan hamil yang bersangkutan dan dengan persetujuan suami, kecuali korban tindak pidana perkosaan.
- Pengecualian persetujuan suami sebagaimana dimaksud pada ayat (1)juga berlaku terhadap korban tindak pidana kekerasan seksual lain yang menyebabkan kehamilan.
- Dalam hal pelaksanaan pelayanan aborsi dilakukan pada orang yang dianggap tidak cakap dalam mengambil keputusan, persetujuan dapat dilakukan oleh keluarga lainnya.
