Mahkamah Konstitusi Terima Ratusan Gugatan Hasil Pilkada 2024

SEAToday.com, Jakarta – Hasil Pilkada 2024 sudah diumumkan. Namun seperti yang sudah diperkirakan banyak pasangan calon yang akan melayangkan gugatan hasil Pilkada ke Mahkamah Konstitusi (MK).
Menurut informasi hingga Senin (9/12) pukul 20.00 WIB sekitar 170 gugatan sengketa Pilkada sudah terdaftar di MK dan tercantum dalam situs mkri.id. Mayoritas penggugat adalah pasangan calon Bupati dan Wakil Bupati serta Wali Kota dan Wakil Wali Kota.
Sementara untuk penggugat calon Gubernur dan Wakil Gubernur sampai Senin (9/12) belum mendaftarkan. Padahal salah satu pasangan calon Gubernur dan Waklil Gubernur DKI Jakarta Ridwan Kamil dan Suswono dikabarkan akan melayangkan gugatan Pilkada 2024.
MK memang menjadi lembaga yang bertugas dan bertanggung jawab dalam memproses gugatan sengketa Pilkada. Hasil dari putusan MK sudah mengikat sehingga semua pihak wajib untuk menghormatinya
Lalu bagaimana cara mendaftarkan perkara sengketa Pilkada ke MK? Tata cara dan syarat dalam pengajuan gugatan hasil Pilkada sudah diatur dalam Peraturan Mahkamah Konstitusi (MK) Nomor 3 Tahun 2024 dan syarat pengajuan gugatan hasil Pilkada diatur dalam UU Nomor 10 Tahun 2016.
Gugatan sengketa hasil Pilkada maksimal atau paling lambat diajukan tiga hari setelah pengumumkan resmi diumumkan. Dalam gugatan harus dilengkapi dengan alat atau dokumen bukti keputusan KPU tentang hasil rekapitulasi suara.
Apabila saat mengajukan permohonan ada hal-hal yang harus diperbaiki atau dilengkapi maka pemohon paling lambat tiga hari harus memperbaiki dan menyerahkan kembali kepada MK.
Dalam Undang-Undang MK akan memutuskan perkara, perselisihan, sengketa hasil pemilihan kepala daerah paling lama 45 hari setelah diterima permohonan. Kita tunggu saja kira-kira sekitar bulan Januari 2025 hasil gugatan Pilkada di MK akan diumumkan setelah menjalani proses persidangan.
